The essay explores how ideas about social justice and economic performance shaped the debates over federal taxation in the United States since the origins of the republic. The debates were most intense during major national emergencies (the American Revolution, the Civil War, World War I, the Great Depression, and World War II), and each debate produced a new tax regime-a tax system with its own characteristic tax base, rate structure, administration apparatus, and social purpose. The criterion of "ability to pay" (...) and a concern for economic efficiency powerfully shaped the formation of every tax regime, but "ability to pay" became the more influential of the two considerations during the national crises of the twentieth century. Patient decision aids enable patients to be better informed about the potential benefits and harms of their healthcare options. Certification of patient decision aids at the national level in the United States is a critical step towards responsible governance—primarily as a quality measure that increases patients’ safety, as mandated in the U.S. Patient Protection and Affordable Care Act (PPACA). Certification would provide a verification process to identify conflicts of interest that may otherwise bias the scientific evidence presented in decision aids. (...) Certification also benefits clinicians who may otherwise face malpractice claims based on harm to patients caused by possible reliance on patient decision aids that are inaccurate, incomplete, or presented in a manner that biases the patient’s decision. Existing work by the International Patient Decision Aid Standards Collaboration could guide the establishment of a certification process within the U.S. This article argues for national certification of patient decision aids and discusses how that may be achieved. Eisner, Lee Jacks Professor of Education and Professor of ArtWhen I was invited by the Editor of The Journal of Aesthetic Education to respond to two unidentified reviews of my latest book, The Arts and the Creation of Mind, I thought that I would encounter a bevy of negatively critical comments, which (...) would give me the opportunity to respond equally as critically to theirs. Fortunately — perhaps unfortunately — the reviews prepared by Arthur Efland and Richard Siegesmund are not in the least bit negative. This, of course, is a boon to the book's author, but a bane to the creation of lively debate. I am happy to say that though their purposes differ, both Efland and Siegesmund got it essentially right. Efland's comments put my work in a historical context, particularly the emergence of interest in cognition and, in general, in the higher mental processes as they were called during the 1960s, 1970s, and 1980s. It is true that interest in cognition was in the air at that time, in the field of philosophy, and in the fields of linguistics and psychology as well. My own work is a part of that particular zeitgeist in the twentieth century.I was not aware at the time that I was being influenced by such a broad movement, but, alas or alack, I was. In some ways, the writing that John Dewey did during the early and mid 1930s, particularly his work on art as rendered in Art as Experience, presaged the interest linguists, psychologists, and philosophers developed in the conditions of communication and its relationship to symbolic systems and thought.1 Dewey has been a major influence on my thinking as have Susanne Langer and later Nelson Goodman.2 [End Page 96] The historical perspective that Efland provides is a useful accounting of where ideas about cognition were and where they are now. I do not know whether I have extended the thinking that is being done on cognition, but I certainly have tried to provide a fulsome account of the connections between cognition and the educational mission of the arts, especially the visual arts. Efland's historical portrayal is a useful picture of the period and, I would say, the significance of this way of thinking for education.Siegesmund pushes farther than Efland, in my view, into the sources of human understanding, particularly the function of somatic knowledge in grasping, or better yet, framing meaning. His notion of what might perhaps best be called visual reasoning marries two concepts that are seldom related; the visual and the reasonable. Reason is often associated with matters of logic, and matters of logic pertain to connections between language in its formal sense and with the relationships among numbers within numerical systems. Qualitative relationships are not typically regarded as manifestations, even at their best, of rational forms of thinking. Emotional, yes. Rational, no. As readers of my works know, I reject that conception of the limits of human rationality and Siegesmund does as well. His focus on embodied knowledge, or what is sometimes called somatic knowledge, is a promising conception of the sources of choice and judgment. There is, after all, more known than what can be told, to paraphrase Michael Polayni.3What pleases me most about Siegesmund's account of my work is its receptivity to the students he teaches. The ultimate educational test of any piece of writing is the extent to which people see meaning in it and apparently, at least for the students that Siegesmund teaches, meaning for most is there. I am pleased. What I have always tried to do in my work is to avoid prescribing recipes or formulaic procedures because I do not believe either works very well when one is working with human beings, but rather to provide concepts through which the educational world can be viewed, practice reflected upon, options identified, and action taken. Compared to approach motivation, avoidance motivation evokes vigilance, attention to detail, systematic information processing, and the recruitment of cognitive resources. From a conservation of energy perspective it follows that people would be reluctant to engage in the kind of effortful cognitive processing evoked by avoidance motivation, unless the benefits of expending this energy outweigh the costs. We put forward three empirically testable propositions concerning approach and avoidance motivation, investment of energy, and the consequences of such investments. Specifically, we propose that (...) compared to approach-motivated people, avoidance-motivated people (a) carefully select situations in which they exert such cognitive effort, (b) only perform well in the absence of distracters that occupy cognitive resources, and (c) become depleted after exerting such cognitive effort. Rare copy number variants have a prominent role in the aetiology of schizophrenia and other neuropsychiatric disorders. Substantial risk for schizophrenia is conferred by large CNVs at several loci, including microdeletions at 1q21.1, 3q29, 15q13.3 and 22q11.2 and microduplication at 16p11.2. However, these CNVs collectively account for a small fraction of cases, and the relevant genes and neurobiological mechanisms are not well understood. Here we performed a large two-stage genome-wide scan of rare CNVs and report the significant association of copy (...) number gains at chromosome 7q36.3 with schizophrenia. Microduplications with variable breakpoints occurred within a 362-kilobase region and were detected in 29 of 8,290 patients versus 2 of 7,431 controls in the combined sample. All duplications overlapped or were located within 89 kilobases upstream of the vasoactive intestinal peptide receptor gene VIPR2. VIPR2 transcription and cyclic-AMP signalling were significantly increased in cultured lymphocytes from patients with microduplications of 7q36.3. These findings implicate altered vasoactive intestinal peptide signalling in the pathogenesis of schizophrenia and indicate the VPAC2 receptor as a potential target for the development of new antipsychotic drugs. © 2011 Macmillan Publishers Limited. Incarceration served as a primary apparatus by which abolition democracy was defeated after Reconstruction. Carceral institutions—such as the penitentiary, the convict-lease system, and the chain gang—functioned to demarcate the racial limits of citizenship and to impede equal political power. This article turns to W. E. B. Du Bois to argue that incarceration constrains democratic political equality. Turning to Du Bois’s treatment of crime and imprisonment in works including The Philadelphia Negro (1899), “The Spawn of Slavery” (1901), and The Souls of (...) Black Folk (1903), alongside archival material, I situate incarceration in Du Bois’s democratic thought. According to Du Bois, carceral institutions bounded ideas of full citizenship, fueled panic over Black “criminality,” fomented feelings of inferiority, and hampered the possibility for abolition democracy, a multiracial, multiclass movement committed to worker democracy and a future rid of slavery and subjugation. Du Bois shows us how carceral institutions run into tension with democratic ideals. (shrink)

Hegel scholars will be pleased to discover Miller’s new translation of Hegel’s Philosophical Propaedeutic, which is a revised and completed version of W.T. Harris’ partial translation which appeared in the 1860s. PPr, discovered by Karl Rosenkranz in 1838 and published in 1840, is based upon lectures given when Hegel was Rector of the Gymnasium in Nuremberg between 1808 and 1811. Rosenkranz’s ordering of the lectures according to age levels has been preserved by the editors of the new translation, Michael George (...) and Andrew Vincent. In their introduction, they explain that the Rosenkranz ordering was unfortunately disregarded in the Theorie Werkausgabe, edited by Eva Moldenhauer and Karl Markus Michel, brought out in the 1970s by the Suhrkamp Verlag of Frankfurt. In the fourth volume of this edition, the lectures were ordered according to chronology. It will be interesting, no doubt, to see how the Hegel-Archiv scholars will handle this when their edition of PPr is published. In 2001, the algebraico-tree-theoretic simplicity hierarchical structure of J. H. Conway’s ordered field ${\mathbf {No}}$ of surreal numbers was brought to the fore by the first author and employed to provide necessary and sufficient conditions for an ordered field to be isomorphic to an initial subfield of ${\mathbf {No}}$, i.e. a subfield of ${\mathbf {No}}$ that is an initial subtree of ${\mathbf {No}}$. In this sequel, analogous results are established for ordered exponential fields, making use of a slight generalization of (...) Schmeling’s conception of a transseries field. It is further shown that a wide range of ordered exponential fields are isomorphic to initial exponential subfields of $$. These include all models of $T$, where ${\mathbb R}_W$ is the reals expanded by a convergent Weierstrass system W. Of these, those we call trigonometric-exponential fields are given particular attention. It is shown that the exponential functions on the initial trigonometric-exponential subfields of ${\mathbf {No}}$, which includes ${\mathbf {No}}$ itself, extend to canonical exponential functions on their surcomplex counterparts. The image of the canonical map of the ordered exponential field ${\mathbb T}^{LE}$ of logarithmic-exponential transseries into ${\mathbf {No}}$ is shown to be initial, as are the ordered exponential fields ${\mathbb R})^{EL}$ and ${\mathbb R}\langle \langle \omega \rangle \rangle $. These comments on Cohen’s paper (IJPP, this issue) focus on the question of whether Cohen’s attempt to derive antidotes from incompatible or contradictory philosophical camps— such as Hume’s subjective theory of beauty, on the one hand, and Augustine’s objectivist account—present a fatal problem for Cohen’s LBT. The paper concludes with suggesting a constructive way around the problem.

Profiles of art education in nineteen countries around the world by citizens or longtime residents of those countries comprise the core of this book. Guidelines for the cross-cultural study of art education are presented by the editors in a general introduction and three part introductions, and also by contributing specialists. The nineteen national profiles, with accompanying examples of children's artwork, make up the largest section of the book, Part II. Rabbi Elliot N. Dorff, the Sol and Anne Dorff Distinguished Professor of Philosophy and Rector of American Jewish University in Los Angeles, is one of today's leading Jewish ethicists. In this study, I examine Susan Taubes’s criticism of Heidegger’s Seinsdenken that pivots around her contention that he absolutized the nothingness of being in a manner that is analogous to but yet significantly different than the role assigned to the Godhead on the part of many mystical visionaries. The common denominator is in Heidegger’s insistence on being to the neglect of fully engaging with the rhythms of life. As a consequence, there is no purchase on the chaotic, which falls outside (...) the purview of what can be signified, and in the absence of the unsignifiable, there can be no signification. Every attempt to reconstruct the broken world into a totality contains the flaw of an ontological untruth. The effort at totalization is not only the methodological weakness of tragedy and mysticism, but it is also the nihilistic basis of the role accorded to the nothingness of being in Heidegger’s Seinsdenken. The erroneous nature of the world is not denied by Susan, but she struggled to uphold the ontological untruth that what is most wrong in our existence is what is most precious. The paradoxical retrieval of the truth of this untruth affords the poetic soul the opportunity to confront the limit by breaking it, an infringement of boundary that is redolent equally with the enduring transience of love and the transient endurance of death. Children are not simply molded by the environment; through constant inference and interpretation, they actively shape their own social world. This book is about that process. In this erudite new work, Elliot R. Wolfson explores philosophical gnosis in the writings of Susan Taubes, Gillian Rose, and Edith Wyschogrod. The juxtaposition of these three extraordinary, albeit relatively neglected, philosophers provides a prism through which Wolfson scrutinizes the interplay of ethics, politics, and theology. The bond that ties together the diverse and multifaceted worldviews promulgated by Taubes, Rose, and Wyschogrod is the mutual recognition of the need to enunciate a response to the calamities of the twentieth century (...) based on an incontrovertible acknowledgment of the decadence and malevolence of human beings, without, however, succumbing to acrimony and despair. The speculation of each of these philosophers on melancholia and the tragicomedy of being is unquestionably intricate, exhibiting subtle variations and idiosyncrasies, but we can nevertheless identify a common denominator in their attempt to find the midpoint positioned between hope and hopelessness. As Wolfson articulates, Taubes, Rose, and Wyschogrod exemplify a philosophical sensibility informed by a nocturnal seeing, which is not merely a seeing in the night but rather a seeing of the night. Ultimately, the book reveals the potential for these thinkers' ideas to enhance our moral sensitivity and to encourage participation in the ongoing struggle for meaning and decency in the present. A parallel may be drawn between the communicative aspect of civil disobedience and the communicative aspect of lawful punishment by the state. In punishing an offender, the state seeks to communicate both its condemnation of the crime committed and its desire for repentance and reformation on the part of the offender. Similarly, in civilly disobeying the law, a disobedient seeks to convey both her condemnation of a certain law or policy and her desire for recognition that a lasting change in (...) policy is required. When disobedients and authorities target each other, their confrontation allows for a direct comparison of the respective justifiability of their conduct. Their confrontation is explored in this paper with an eye to analysing how civil disobedients and authorities should engage with each other. (shrink)

Analytic philosophy has largely neglected the topic of homelessness. The few notable exceptions, including work by Jeremy Waldron and Christopher Essert, focus on our interests in shelter, housing, and property rights, but ignore the key social functions that a home performs as a place in which we are welcomed, accepted, and respected. This paper identifies a ladder of home-related concepts which begins with the minimal notion of temporary shelter, then moves to persistent shelter and housing, and finally to the rich (...) notion of a home which focuses on meeting our social needs including, specifically, our needs to belong and to have meaningful control over our social environment. This concept-ladder enables us to distinguish the shelterless from the sheltered; the unhoused from the housed; and the unhomed from the homed. It also enables us to decouple the concept of a home from property rights, which reveals potential complications in people’s living arrangements. For instance, a person could be sheltered but unhoused, housed but homeless, or, indeed, unhoused but homed. We show that we should reserve the concept of home to capture the rich idea of a place of belonging in which our core social needs are met. (shrink)

Clear and distinct perception is the centrepiece of Descartes’s philosophy — it is the source of all certainty — but what does he mean by ‘clear’ and ‘distinct’? According to the prevailing approach, what it means for a perception to be clear is that its content has a certain objective property, like truth. I argue instead that clarity is at least partly a subjective, phenomenal quality whereby a content is presented as true to the perceiving subject. Clarity comes in degrees. (...) Any weak degree of clarity, available to the senses, can be merely subjective, since what it presents as true may not actually be true. But complete clarity, available to intellectual perception, has an objective dimension, since what it presents as true is always some truth, some bit of reality. Further, I argue that the other perceptual qualities that Descartes identifies — obscurity, confusion, and distinctness — are all defined in terms of clarity. Of particular note is the fact that distinctness is not a positive feature to be added to clarity: a distinct perception is just a completely clear perception. (shrink)
